Workforce restructuring

Retrenchment in Singapore

A retrenchment exercise should connect the business reason, selection process, notice, payments and required notification in one defensible record.

What should employers and employees check first?

An employer should define the reorganisation or redundancy, consider alternatives, apply fair selection criteria and plan the communication, notice, payments and handover. An employee should preserve the contract, payslips, role history, selection explanation and termination documents.

Retrenchment

What evidence should an employer or employee organise?

Assess the role change, selection process, contract and payments together. Record what was decided, when the employee was informed and the reasons given at the time.

Employer
Preserve the business rationale, selection pool, criteria and decision records.
Employee
Keep the role history, correspondence, contract and notice or payment documents.
Notification
Check whether the business and employee threshold triggers MOM notification and record the notification date.
Disputed decision
Identify the disputed reason, selection or payment and any applicable claim deadline.
Documents for an initial review

Is the termination genuinely a retrenchment?

Review the organisation change, old and new roles, headcount plan and whether the vacancy will be refilled. MOM states that an employer terminating without a plan to fill the vacancy soon is presumed to have retrenched the employee.

A restructuring can still be genuine where duties are redistributed. The employer should document the business rationale and avoid disguising performance or discriminatory decisions as redundancy.

How should employees be selected?

MOM’s responsible-retrenchment guidance calls for fair and objective selection linked to future business needs and a strong Singaporean core. Criteria should be defined before scoring and applied consistently.

Records should explain the comparison pool, criteria, decision-makers, conflicts and any moderation. Sensitive personal characteristics should be handled lawfully.

What notice and payments may apply?

The contract controls the notice period, subject to applicable law. Final salary, unused leave and notice pay should be checked separately from any retrenchment benefit.

MOM states that employees with at least two years’ service are eligible for retrenchment benefit and that the amount depends on the contract, collective agreement or negotiation. Current guidance should be checked for the specific exercise.

When must MOM be notified?

MOM states that Singapore-registered employers with at least ten employees who retrench any employee must submit a Mandatory Retrenchment Notification within five working days after informing the affected employee. Read MOM’s notification requirements (checked 18 October 2026).

Confirm the current threshold and filing requirements at the time of the exercise. Keep evidence of the employee communication and notification.

What if retrenchment is disputed?

A dispute may concern salary, benefits, selection, discrimination, the true reason for termination or contractual procedure. TADM is the first route for specified employment claims.

Organise the business rationale and individual evidence separately. Avoid retrospective documents that do not reflect the actual decision process.
