What must happen before an estate is administered?
Locate the latest will, identify the named executor and confirm whether a probate or administration application already exists. Secure property and records without treating estate assets as personal assets.
The Family Justice Courts explain that probate and administration appoints a person to manage the estate. A Grant of Probate generally applies where a valid will names the executor; Letters of Administration generally apply where there is no valid will and an entitled beneficiary applies.
Probate and estate administration
Which estate pathway applies?
Start with the will, the proposed personal representative, the assets and liabilities, and any immediate concern. Identify a dispute before choosing the procedural next step.
- Planning a will
- If the person is planning during their lifetime, begin with will-writing and asset arrangements.
- Executor and grant
- Where there is a will, identify the executor and obtain advice on whether a grant is needed.
- Administration
- Organise the estate’s assets, liabilities, records and post-grant responsibilities.
- Dispute
- Identify whether the concern involves validity, accounts, conduct or ownership before seeking a remedy.
Is a grant required?
A grant gives the personal representative recognised authority to deal with estate assets. Some jointly held, nominated or low-value assets may follow separate processes.
Check each institution and asset rather than assuming one rule applies to the whole estate. The Public Trustee may administer qualifying estates within the current statutory criteria.
How should assets and liabilities be identified?
Prepare a schedule covering cash, property, investments, companies, insurance, CPF, digital assets, debts, tax and foreign interests. Record legal ownership and any nomination or trust claim.
Secure statements and date-of-death values. Keep estate money separate and document every receipt and payment.

What does the application involve?
The applicant files the required originating and supporting documents, identifies the estate and later provides the Schedule of Assets. Current forms and filing routes should be used.
The original will requires careful custody and may need verification. Renunciations, foreign documents, missing information or competing interests can change the process.
When can assets be distributed?
The personal representative should first establish authority, collect assets, address liabilities and expenses, resolve tax and claims, and confirm the beneficiaries.
Premature distribution can expose the representative to difficulty if a debt, claim or later asset emerges. Interim distribution needs a reasoned assessment and records.
What changes with foreign assets or parties?
The estate may require resealing, a separate foreign grant, foreign-law evidence, translations or tax advice. Domicile and asset location can affect succession and administration.
Coordinate jurisdictions so that asset collection, creditor steps and distribution remain consistent.
What if the estate is disputed?
A dispute may concern the will, appointment, beneficial ownership, administration, account or distribution. Preserve the estate while the issue is defined.
Mediation may assist, but urgent court or protective steps may be needed where assets or the grant are at risk.

Frequently asked questions
Probate generally applies when a valid will names an executor. Letters of Administration generally apply when there is no valid will and an entitled person seeks appointment as administrator.
No. Some nominated, jointly held or qualifying low-value assets may be dealt with through another process. Each asset holder’s requirements should be checked.
Authority and the nature of the expense matter. Estate funds should be protected, separated and recorded; obtain advice before dealing with assets.
Estate liabilities are generally addressed from estate assets through the administration. Personal liability can arise from mishandling, so the order and evidence matter.
After authority, assets, liabilities, tax, claims and beneficiary entitlements are sufficiently established. The timing depends on the estate.
Additional grants, resealing or local advice may be required in the country where an asset is located.
