What should you do when assets may be disappearing?
Start with the transaction trail. Identify the asset, the last confirmed holder, the transfer or change that caused concern, the people who gave instructions and the records that still exist. A clear chronology helps distinguish a genuine risk of dissipation from missing information or an ordinary commercial disagreement.
Urgent relief may be available in an appropriate case, but the remedy must fit the claim and the evidence. Asset tracing supports recovery; it does not itself create a right to search another person’s affairs. Justin Chan Chambers can assess the underlying cause of action, the evidence available and the safest next procedural step.
Asset tracing
What should an asset trail establish?
Organise the evidence around the asset, the people involved and the claim it may support. Identify any impending transfer or loss of records for the lawyer’s attention.
- Asset or payment
- Identify the account, property, company interest or transaction and the relevant date.
- Ownership and control
- Separate the recorded owner, the person controlling the asset and any disputed beneficial interest.
- Supporting records
- Preserve originals and record where each document came from. Use only records you may lawfully access.
- Recovery decision
- Consider the claim, location, available remedies and likely recovery before committing to extensive tracing.
Which evidence should be preserved first?
Keep lawful copies of bank statements, payment instructions, contracts, invoices, ledgers, company records, emails, messaging records and asset registers. Preserve original formats and metadata where possible. Record when each item was obtained and avoid altering source files.
A working schedule should show dates, amounts, currencies, sender and recipient details, account or wallet identifiers, stated purpose and any later movement. Gaps belong in the schedule as open questions; they should not be filled with assumptions.
- Build one dated chronology across people, entities and accounts.
- Separate verified transactions from suspicions and explanations still to be tested.
- Record known overseas connections, nominees, related companies and intermediaries.
- Protect privileged communications and observe lawful access boundaries.
When can preservation relief be considered?
The Rules of Court 2021 allow applications for injunctions and search orders, including urgent applications before an originating process is issued. The court expects an applicant seeking relief without notice to explain the urgency, the merits and why the respondent should not first be informed.
A freezing order restrains dealings with assets; it does not give the claimant ownership of them. A search order is intrusive and carries demanding safeguards. Full and frank disclosure is critical when the other party is absent from the hearing.
- What legal claim is being protected?
- What evidence shows a real risk to assets or records?
- Which assets, people and jurisdictions can be identified precisely?
- What undertaking, security or practical supervision may be required?

How can disclosure help reconstruct the trail?
Disclosure may come from an opposing party, a bank, a company, an intermediary or another person who holds relevant information. The route depends on the proceedings, the connection between that person and the wrongdoing, and the type of record sought.
A focused request is more useful than a broad demand. It should identify the transaction or asset, explain why the material matters and preserve proportionality, confidentiality and procedural fairness.
What changes when assets cross borders?
Cross-border recovery requires early mapping of the relevant courts, entities, accounts and enforcement locations. An order made in Singapore may still require recognition, compliance or parallel action elsewhere.
Counsel should coordinate the sequence of applications so that notice in one country does not undermine preservation in another. Translation, service, foreign-law evidence and local enforcement rules may affect timing and cost.
What outcomes can an asset-tracing strategy support?
The immediate objective may be information, preservation, negotiation leverage or enforcement. The final remedy might concern damages, repayment, proprietary relief, an account, recovery of specific property or enforcement of a judgment. Each depends on the cause of action and the evidence.
A practical strategy also tests recoverability. Even a strong legal claim may require decisions about proportionality, asset value, competing creditors, insolvency risk and the cost of pursuing multiple jurisdictions.
How can Justin Chan Chambers help?
An initial review can organise the chronology, identify the possible claim, assess urgency and define the next evidence request. Where another jurisdiction or specialist discipline is involved, the work can be scoped around the decisions that must be made in Singapore.
Bring the key documents you already hold, details of any imminent transfer or hearing, known asset locations and a short statement of the outcome you need. Early accuracy is more useful than a large unsorted document set.
What should you prepare for an initial review?
- A dated transaction chronology
- Bank, payment, company and ownership records
- Known account, wallet, property and entity details
- Communications about transfers, control or concealment
- Existing orders, claims, demands and foreign proceedings
- Any imminent sale, withdrawal, restructuring or document loss
Frequently asked questions
No. Tracing work supports a recognised claim or enforcement route. The legal basis may arise from contract, fraud, breach of trust, fiduciary duty, unjust enrichment, insolvency or ownership, depending on the facts.
Tracing seeks to identify the path, location or substitute form of value. A freezing order restrains dealings with assets to protect a possible judgment; it does not transfer ownership to the applicant.
The Rules of Court permit without-notice applications in appropriate urgent cases. The applicant must explain the urgency and make full and frank disclosure of material facts, including points that may assist the other side.
A Singapore court may make orders with cross-border effect in an appropriate case, but practical enforcement and recognition depend on the foreign jurisdiction. Coordinated local advice may be required.
Avoid accessing accounts or devices without authority, altering evidence, confronting people in a way that increases the risk of dissipation, or making public allegations that cannot yet be proved.
Seek advice promptly where a sale, withdrawal, transfer, liquidation, travel event or loss of records appears imminent. The available response depends on evidence, jurisdiction and procedural readiness.
