What must a creditor prove?
A creditor should establish the contract or other basis of the debt, its own performance, the amount due and any required invoice or notice. The debtor's response may raise set-off, defective performance, limitation, insolvency or another defence.
- Reconcile invoices, payments, credits and interest.
- Identify the correct debtor and any guarantee or security.
- Check contractual notices, dispute clauses and limitation.
- Separate an undisputed debt from a damages claim needing proof.
