Contested probate

Contesting a will in Singapore

A concern about a will should be translated into a specific legal issue and supported by evidence. Suspicion, disappointment or unequal gifts alone do not establish invalidity.

What should happen before a grant is issued?

Confirm the latest will, whether a probate application has begun and whether a grant has been issued. Identify the proposed ground of challenge and preserve the documents, medical evidence and witness information relevant to execution and instructions.

Contesting a will

What evidence supports the concern about the will?

Identify the specific concern about the will and the facts supporting it. A concern requiring investigation is different from evidence establishing that a will is invalid.

Will versions
Locate the available versions and identify any changes relevant to the concern.
Execution
Record the known signing circumstances, witnesses and relevant contemporaneous material.
Capacity or influence
Identify available medical records, communications and witness evidence relevant to the alleged ground.
Grant position
Establish whether a grant has been applied for or issued and identify the next procedural step.
Documents for an initial review

What grounds may require investigation?

Possible issues can include execution formalities, testamentary capacity, knowledge and approval, undue influence, fraud, forgery, revocation or the existence of a later will.

Each ground has distinct elements and evidence. A strained relationship or unexpected distribution may justify enquiries, but it does not prove the will invalid.

Which evidence matters most?

Obtain the original will history, drafts, attendance notes, execution details, witness evidence, relevant medical records, communications and prior estate-planning documents.

Build a chronology around instructions, signing, capacity, dependence, family events and asset changes. Preserve originals and avoid coaching witnesses.

What does a probate caveat do?

The Family Justice Courts’ forms describe a caveat as preventing a grant from being made without notice to the caveator. Current rules and form requirements should be checked before filing.

A person warning the caveat may require the caveator to state the interest relied on. The dispute can then move into contested probate procedure.

What if a grant has already been issued?

The available route changes once a grant exists. Advice may address revocation or amendment of the grant, estate preservation, the personal representative’s conduct and recovery of distributed assets.

Prompt action matters because administration may continue and third parties may become involved.

Can the dispute settle?

Parties may resolve information, administration or distribution issues by agreement, subject to capacity, tax, trust and court considerations.

A settlement should address the validity position, grant, personal representative, costs, releases and implementation across every affected asset.
